In the terms and conditions:
“Application/Apply-ing” means the process you undertake when you apply for a GEMt account which includes the provision of Personal Information and an identification process via the website.
“Contribution” means the amount guests deposit towards an account/event.
“Contributor” means the person making a donation into an account/event
“Personal Information” includes name, date of birth, current address, previous addresses, telephone numbers, e-mail address, occupation, drivers license number, credit reference reporting, bank account details, credit card details, logon identification numbers, pin numbers, passwords, security codes.
“Website” means gemtinfo.com.au
“Course Package” means the package you receive upon attending a training course.
A reference to “we”, “us” or “our” is a reference GEMt Pty Ltd.
A reference to “you” or “your” is a reference to the person who is taken to agree to these terms and conditions under Clause 2.
3. Disclaimer of Liability
3.2 GEMt Pty Ltd makes no representations or warranties of any kind, express or implied, concerning the operation of this site, or any related information, content, materials or products, except as required under applicable laws.
3.3 GEMt Pty Ltd shall not be held liable for any improper or incorrect use of the materials, products, services or information described and/or contained in this site and assumes no responsibility for the user’s use of them. In no event shall GEMt Pty Ltd be liable for any direct, indirect, incidental, special, exemplary or consequential damages including, but not limited to, procurement or substitute goods or services, loss of use, data, or profits, or business interruption.
3.3 This disclaimer of liability applies to any damages or injury, including but not limited to those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action.
3.4 GEMt Pty Ltd does not warrant or make any representations regarding the use or the results of the use of the materials, products, services or information in this site. Changes may be periodically made to the content of our materials, products, services or information in this site and these changes may or may not be reflected in the materials or information as presented in the site. Additionally, due to the dynamic nature of the Internet, materials and information freely available one day may be restricted the next day, or undiscoverable due to changes in the organization of menus, homepages or files.
4. Agreeing to the Terms and Conditions
4.1 These terms and conditions apply to each GEMt Pty Ltd user
4.2 You agree to be bound by these terms and conditions by contributing, applying, purchasing, activating, using, or attempting to use the GEMt Pty Ltd service/product.
5.1 GEMt Pty Ltd does NOT charge a credit card processing fee.
5.2 GEMt Pty Ltd accepts Visa and MasterCard credit cards.
5.3 We will not be accountable for extended delays associated with direct deposits or cheque clearances as these are subject to your financial institution.
5.4 Fees incurred from financial institutions as a result of incorrect account details supplied will be passed on to account holders.
5.5 If a contribution is made by a company holding an active A.B.N a Tax Invoice can be supplied upon request.
6. Refunds, Transfers & Credits
6.1 If a course is cancelled for any reason by GEMt then as much notice as possible will be given to course participants. In this instance, course fees only will be returned in full as soon as possible. For International courses, GEMt accepts and refunds course fees in AUD. We are not accountable for fluctuations in exchange rates. NB. GEMt is not liable nor responsible for any other out of pocket expenses incurred by registrants due to course cancellations or venue changes; this may include flights, accommodation or bank fees on financial transfers.
Regions are defined as:
(i) Australia / New Zealand
Transfers within the same region:
If you wish to transfer to another GEMt course within the same region, the following fees will be incurred:
(i) Outside of 30 days of course commencement = FREE transfer to the requested course
(ii) Under 30 days of course commencement = 25% administration charge
Transfers between regions incur the following charges:
(i) Outside of 30 days of course commencement = 25% administration charge
(ii) Under 30 days of course commencement = 50% administration charge
(i) Outside 30 days of course commencement = 25% administration charge
(ii) Under 30 days of course commencement = 75% administration charge
(iii) Under 14 days of course commencement = 100% administration charge, i.e. no refund
7. GEMt Membership
7.1 GEMt members can opt out of membership at any time.
7.2 Note that there is a no refund policy on the monthly or annual membership fee. In particular, there is no pro rata refund on any unused portion of an annual membership.
8. Security & Financial Information
8.1 Personal information such as credit card number is encrypted using industry standard Secure Socket Layer (SSL) technology before it is sent via the internet. This method is used by millions of people to shop over the internet. You will know that SSL is active when you see a solid lock or key. All data is secured using 128 bit encryption.
9. Website Changes
9.1 We may change the terms and conditons at our discretion in accordance to fixing errors or in response to customer complaints.
10. Other Sites
10.1 GEMt Pty Ltd is not responsible for the privacy practices of sites that are linked to this site via hyperlinks, banner advertising or otherwise. Please take care at all times to check whose site you are visiting.
11. Inability to Participate in needling.
11.1 If for any reason a course participant is unable to take needles for the duration of the course e.g. Pregnancy / Religion / Needle Phobic/ Metal allergies… arrangements must be made to bring a friend along to take needles in their place.
11.2 There will be costs involved to cover all catering and prior contact must be made to course co-ordinator at time of registration to arrange such payment.
12. Those Clinicians that have done other courses
12.1 If you have already completed another dry needling course, you are entitled to a 50% discount on the full course fee on Australian held courses. (Not available for Essentials, Upper Limb, Lower Limb or guest courses) Read more
